The Ohio State University and Overtime Sports Fight Over the Letter “O”

The Ohio State University and sports website, Overtime Sports, are involved in a heated federal court litigation over Overtime Sports’ logo.  Overtime Sports uses a black and white rounded “O” as its logo, which Ohio State claims is too similar to its block shaped red, black, and white “O.”  Ohio State sent a cease and desist letter and Overtime Sports responded by firing off a lawsuit in the United States District Court for the Eastern District of New York seeking a legal declaration for the continued use of its logo.

Ohio State vs. Overtime Sports. Are these logos similar?

Are these logos too similar that they would cause confusion?  Should Ohio State have the right to solely use the letter “O?”  What about others, like Oregon’s green “O?”
